SiriusXM host Megyn Kelly didn’t hold back when dissing former President Joe Biden’s controversial pardons on her show Monday.
Biden issued a flurry of pardons throughout the day Monday, some revealed moments before President Donald Trump’s inauguration.
The individuals pardoned included high-profile names such as Dr. Anthony Fauci, former Chairman of the Joint Chiefs of Staff Mark Milley, nine members of the January 6 Select Committee, and members of his own family.
Biden defended his actions, labeling investigations against them as “unjustified and politically motivated prosecutions.”

“I believe in the rule of law, and I am optimistic that the strength of our legal institutions will ultimately prevail over politics,” Biden tweeted.
“But these are exceptional circumstances, and I cannot in good conscience do nothing. Baseless and politically motivated investigations wreak havoc on the lives, safety, and financial security of targeted individuals and their families.”
The titular host detailed the pardons on “The Megyn Kelly Show,” taking aim at Fauci’s specific pardon, which stretches as far back as 2014.
“Let’s go to the pardons because this is just egregious. Everybody under the sun, I mean, the J6 committee members, his entire family, right? Mark Milley and Dr. Fauci. By the way, the pardons go back, especially Fauci, go back to 2014,” Kelly began.

“It starts in 2014 forward. What the hell was he doing in 2014? It’s because he funded gain of function research. It’s because he was behind the problem that caused the damn pandemic.”
Kelly pointed out that there remains legal ambiguity about whether a pardon must be actively accepted to be valid, adding that many legal experts lean toward the necessity of such an acknowledgment.
“But there’s a question about whether it’s valid if they don’t accept. I mean, there’s a legal debate on whether you must say I accept. I think most lawyers say, yeah, you have to say I accept it in order for it to be valid for you,” Kelly explained.

“So the Fauci one is the one that has me most ticked off. Because I really do think Fauci lied repeatedly to Congress. Rand Paul certainly thinks that, and I think was preparing to go after him.”
Despite her frustrations about Fauci’s pardon, Kelly admitted there hasn’t been any definitive evidence of Fauci being directly responsible for the COVID-19 virus.
Nonetheless, she stressed that Fauci’s past involvement in funding gain-of-function research remains a significant concern worth investigating further.

She also pointed out a critical caveat of pardons—their inability to shield individuals from state-level legal issues.
“So that’s the silver lining. They all have to testify fully. They cannot plead the Fifth. By the way, it doesn’t stop any investigations whatsoever, or civil lawsuits. You know what else it doesn’t stop? Or state lawsuits. State prosecutions,” Kelly said.
“You can be prosecuted by the state, a federal pardon does not—that was Trump’s problem, remember?”
She elaborated further, citing Trump’s own legal predicaments as a parallel.
“We were saying like he could pardon himself, but only for the federal crimes, not for those state prosecutions in New York or in Georgia,” Kelly continued.
“Well, guess what, Dr. Fauci, and J6 committee members, and General Milley, you’re all in the same position,” she added.
Fauci, who testified before the House Subcommittee on the Coronavirus Pandemic earlier this year, faced scrutiny for discussing vaccine strategies in a 2020 audio recording.
His comments sparked controversy as he reportedly advocated pushing vaccinations on Americans until they would “lose their ideological bulls**t.”
When questioned, Fauci clarified that his statement didn’t target individuals opposed to the COVID-19 vaccine.

On Monday, Fauci responded with gratitude to Biden’s pardon with gratitude, but denied any wrongdoing.
“Let me be perfectly clear: I have committed no crime and there are no possible grounds for any allegation or threat of criminal investigation or prosecution of me,” Fauci stated to POLITICO.
He acknowledged the toll these accusations have taken on his personal life, describing the emotional weight of unfounded allegations.
“The mere articulation of these baseless threats, and the potential that they will be acted upon, create immeasurable and intolerable distress for me and my family,” Fauci said.
However, he did note his appreciation for Biden’s action, adding, “That’s why he acknowledges and appreciates the action that President Biden has taken today on my behalf.”
